PURPOSE OF AGREEMENT
The purpose of this agreement is to state the duties and obligations of Home Watch By POPZ and The Client, as well as to specify the respective care and handling of the home and/or other services client desires. The referenced home information is fully described within the contract and said information is necessary for service commitment.
By signing this agreement, The Client acknowledges and certifies the following:
The Client has a legal right to enter into this agreement as the current property owner of record for the inspection property provided below.
- The Client has provided Home Watch by POPZ with a key and, if applicable, the code to activate/deactivate the alarm or other security system.
- The Client must give Home Watch By POPZ access clearence and passcodes in order to enter the community at front gate of gated communities.
- The Client has provided Home Watch by POPZ with a list of any other service providers or individuals who has been granted authority to access or use the property in The Client’s absence, including applicable dates and/or other limitations or conditions on such access.
- Home Watch by POPZ is not a security company and does not provide security services for this property.
- Home Watch by POPZ will not be held liable for any damage (including plants/landscaping), theft, burglary or fire that occurs to the subject property during the time this agreement is valid. In the event of any loss or damage for any reason whatsoever, The Client’s
sources of reimbursement are his/her own resources or property and liability insurers.
- Home Watch by POPZ is not responsible for damage to any vehicle while it is being attended to under this agreement. Any vehicle insurance will be the responsibility of The Client or applicable owner.
- Home Watch by POPZ is not responsible for any injury to any person that occurs on the property.
- Home Watch by POPZ is not responsible for any house alarm fees that may occur while we are providing our services.
HOLD HARMLESS AND INDEMNITY
The Client hereby agrees to indemnify and hold harmless Home Watch By POPZ, its owners, agents, representatives, and employees from any and all liability that may result from any damages, lawsuits, liabilities or expenses claims in connection with the provision of the services described within this agreement, and from all liability for injuries to persons or property suffered or sustained by any person whomsoever. It is The Client's responsibility to carry adequate homeowners insurance to protect the interest of parties hereto.
Home Watch BY POPZ shall not be held responsible for damage which may result from action of others, acts of nature, or other circumstsances beyond the control of Home Watch by POPZ and the services stated herin.
TERMINATION
Either party may terminate this Service Agreement with 30 (thirty) days written notice. Upon cancellation Home Watch By POPZ shall return all keys, gate passes codes, and openers to client and client shall submit all fees due and payable to Home Watch By POPZ within 10 (ten) days of receipt of termination notice The Client is responsible for paying any fees incurred during the 30 day notice period.
GOVERNING LAW
In the event any claims and/or disputes arise from this transaction said dispute shall be goverened by the laws of the State of Florida. The parties agree that if legal procedures are necessary to ensure the provisions of the Agreement, the prevailing party shall recover their reasonable legal fees.
INSURANCE
Home Watch By POPZ is Insured and Bonded
AUTHORIZATION AND APPROVALS
All parties confirm the Service Contract provided by Home Watch By POPZ and the information provided by the client is understood and agreed upon. Inaccurate or incomplete information is the responsibility of the client and
will void all responsibility of said services. This document confirms the approval for limited access to The Client's property for the home monitoring services. Any emergency will be handled as detailed in this form set with charges due upon per agreed conditions.
CONFIDENTIAL INFORMATION
We at Home Watch By POPZ respect our Client's confidential information and privacy. The information collected on this form will only be used by representatives of Home Watch By POPZ on an as needed basis and will NEVER be made available to, rented or sold to third parties.
ADDITIONAL INFORMATION
The Client acknowledges this home watch service is to provide information regarding major changes in the property’s condition. The Client should not assume that ALL changes in the property’s condition will be found and/or noted.
Home Watch by POPZ cannot warrant against break in, vandalism or other acts of nature, the purpose of our service is scheduled observation and inspection, which increases the chances of early problem detection before damage has occurred. The Client should understand they may return to their property to find evidence of mildew, mold, insects, minor water damage, dust, dirt, electrical products that fail to work, etc. Home Watch by
POPZ will note and contact The Client regarding changes in the property that any prudent person would find on a basic walk-through of the property. If The Client has of knowledge of past/re-occurring concerns they would like Home Watch by POPZ to monitor during each inspection, these items must be noted in the Special Instructions area of this agreement and/or The Client may provide them in writing to Home Watch by POPZ.
Should any unexpected fees or costs be incurred Home Watch By POPZ will contact client for approval. These costs will shown as a separate line item on your invoice. We understand emergencies arise and we will be as accommodating as possible to meet such requests Keys, passes, codes, openers are required at the signing of the Service Contract.
Any other services needed please ask as we are available to assist you.
WE ARE HERE FOR ALL YOUR NEEDS. ALWAYS ASK IF YOU NEED SOMETHING DONE.
HOME WATCH BY POPZ REQUIRES A SERVICE CONTRACT FOR ALL WORK TO ENSURE A COMPLETE UNDERSTANDING OF ALL SERVICES EXPECTED. THIS CONTRACT MUST BE SIGNED BY THE CLIENT AND/OR HOMEOWNER BEFORE ANY WORK CAN BEGIN. OUR BILLING IS DONE ON A MONTHLY BASIS WITH PAYMENT EXPECTED NO LATER THAN (15) DAYS OF INVOICE RECEIPT.
PAYMENT IS ACCEPTED BY CASH, CHECK, AND ZELLE. THERE IS A $35 RETURNED CHECK FEE.
I have read, signed, and received a copy of this Service Contract and understand and accept its terms.
